Social Media Content Terms and Conditions
1. Discover Ferries may ask a user “User” for permission to use their Content (through a social media competition or when a User has tagged @discoverferries), In the event that you enter a content competition or indicate you give permission for Discover Ferries to use the Content you agree to be bound by these Terms. Please read and ensure you are in agreement before proceeding.
2. In these Terms, “Content” refers to the photo and/or video, including any sound and accompanying text or comments posted through your account on social media, accompanying metadata such as time and place of creation, your username, and links to your social media profile
“Company”, “We”, “our; or “us” refer to Discover Ferries, part of The UK Chamber of Shipping whose registered office is at 30 Park Street, London SE1 9EQ.
“You” or “your” refer to the person who is agreeing to be bound by these terms and conditions in the manner referred to in condition (1) above
3. We do not claim ownership of your Content but you agree to grant Discover Ferries a licence to use and display the Content, in any media, worldwide, for any lawful commercial purpose, in original or edited form, including: on Discover Ferries social media accounts, websites, blogs, digital displays, advertising, and generally in the promotion of Discover Ferries products or services. Such licence also extend to the Company’s subsidiaries, affiliates, agents, employees, representatives, assigns, licensees, and anyone else acting on behalf of Discover Ferries.
4. Discover Ferries’ rights to use your Content last indefinitely until cancelled by you, which you can do at any time by contacting us by email: info@discoverferries.com. After cancellation we will not reuse your Content. However, please note that past posts may remain visible.
5. The licence you grant to Discover Ferries is on a non-exclusive, fully-paid, royalty-free, transferable, sublicensable basis. Use is at Discover Ferries discretion and we are not obliged to use your Content in any particular way or at all.
6. The User will retain all ownership of the Content (subject to the license granted in these Terms) and will be credited, where possible, by using the users social handle.
7. By approving the Company’s use of the Content, the User represents and warrants that:
i. The User is the sole owner of the Content, and the Content is the User’s original work and has not been copied wholly or substantially from any other source;
ii. Nothing in your Content will be illegal, defamatory, obscene, or threatening to any third party;
iii. The Company’s use of your Content as described in these Terms will not infringe upon the intellectual property, privacy, publicity, statutory, contractual, personal or other rights of any third party, or any law, rule or regulation;
iv. You have obtained appropriate rights and permissions from any and all other persons and/or entities to grant the rights to the Company; and
v. The User is 18 years of age or over, as is everyone else appearing in the Content. If anyone in the Content is below this age, the User undertake and confirms that they have obtained the express consent of the parent or legal guardian of the child.
8. The User expressly release Discover Ferries from and against any and all claims which it may have at any time for remuneration, invasion of privacy, right of publicity, defamation or any other cause of action arising out of the use of the Content or any advertisement, marketing device or other publication materials in which the Content may appear.
9. The User agrees that no advertisement or other materials need be submitted to the User for any further approval. Discover Ferries reserve the right to remove any Content from any or all of the materials in its sole discretion.
10. By approving our use of the Content, you understand that as a User you give us the right to use your personal data, and that of others as may be represented and shown in the Content, which could include your name, social handle or likeness. We will only process this personal data for the purpose of this contract with you and in accordance with our privacy policy here.
11. The Company is the controller of your personal data and individuals can obtain further information or exercise any of their legal rights by contacting us at: info@discoverferries.com.
12. Discover Ferries reserve the right to change these Terms without advance notice by posting a revised Terms. Accordingly, Users should review the Terms each time it grants Discover Ferries permission or authorisation to use the Content.
13. These terms and conditions shall be governed by and construed in accordance with the laws of England and the parties agree that any dispute or action arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England.
